1. Acceptance of Terms

By accessing or using the LUNA AI Art Generator application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users of the Service, including visitors, registered users, and subscribers.

2. Description of Service

LUNA is an AI art generator application that allows users to create digital artwork using artificial intelligence technology. The Service includes, but is not limited to, text-to-image generation, photo transformation, AI portrait creation, avatar generation, and related features available through our mobile applications (iOS and Android) and website.

3. User Accounts

  • You may need to create an account to access certain features of the Service.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete information when creating your account.
  • You are responsible for all activities that occur under your account.
  • You must be at least 13 years old to create an account and use the Service.

4. Subscriptions and Payments

4.1 Free Tier

LUNA offers a free version with limited daily credits for AI art generation. Free users have access to a selection of styles and features.

4.2 Pro Subscription

  • LUNA Pro is available as a subscription through the Apple App Store and Google Play Store.
  • Subscription fees are billed in advance on a recurring basis (weekly, monthly, or annually, depending on the plan selected).
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • Refunds are handled by Apple or Google according to their respective refund policies.

5. Ownership of Generated Content

Subject to the following conditions, you own the rights to the images you generate using LUNA:

  • You retain ownership of the AI-generated art you create using the Service.
  • You may use generated content for personal and commercial purposes.
  • You grant LUNA a non-exclusive, worldwide, royalty-free license to use, display, and distribute content you share publicly through the Community feature.
  • Ownership does not extend to the underlying AI models, software, or technology used to generate the content.

6. Acceptable Use

You agree NOT to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Create non-consensual intimate images of real people (deepfakes).
  • Generate content that exploits, harms, or attempts to exploit or harm minors.
  • Infringe upon or violate the intellectual property rights of others.
  • Attempt to deceive or mislead others by presenting AI-generated content as authentic photographs or real events.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated systems, bots, or scrapers to access the Service.
  • Violate any applicable laws or regulations.

7. Intellectual Property

The Service, including its original content (excluding user-generated content), features, and functionality, is and will remain the exclusive property of LUNA and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Third-Party Services

The Service utilizes third-party services including OpenAI, Firebase, Microsoft Azure, Google Cloud Platform, Replicate, AppsFlyer, Meta Pixel, and Google Analytics. Your use of the Service is also subject to the terms and policies of these third-party providers. We are not responsible for the practices of these third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

11. Content Moderation

We reserve the right to review, moderate, and remove any content generated through the Service that violates these Terms or our content policies. We may also suspend or terminate accounts that repeatedly violate our policies. AI-generated content may be subject to automated safety filters.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
